A gay couple in Nevada is suing the state because of its policies regarding same-sex marriage. In their suit, they claim that it is unjust for them not to be called "married" by law. Gay marriage has never been legal in Nevada. With this lawsuit, the couple hopes for that to change. They claim that because they do not have the title of marriage, they are being denied dignity and respect.
I think that this lawsuit will be very costly for the plaintiffs. The couple will go to court only to be told that the state makes its decisions and one cannot sue for an unpopular decision. They will have blown thousands of dollars to no avail. If gay couples want to change the laws, they can advocate for it. Lawsuits will get nowhere. If they have enough money to afford a lawyer, then it stands to reason that they could easily move to another place like Iowa where gay marriage is legal.
Hopefully the lawsuit can help them legalize gay marriage in Nevada.
ReplyDeleteI have to disagree with you. A lawsuit accually brings change to legal things. The idea behind it all is that they want Gay Marriage legal everywhere, not just say "oh... its fine, I can just give up all my friends, family, and neighbors just so I can get married." Theres more to all this then just money and marriage. If one person is willing to bring legal action to the state, then maybe another person can do so as well!
ReplyDeleteI do agree with you that if they have the money to go to court, why not just move where it is legal and they do not have to deal with that. But also I could see if they have family and friends in Nevada why they may not want to leave, especially if they are supportive. It would be hard leaving all the support you had. I'm curious though, if they were to get married here and then moved to Nevada would it still be recognized in Nevada, or once they moved back would they no longer be considered married?
